Sentencing — aggravated robbery — aggravated driving while disqualified — theft — injuring with intent to injure — Waru v R [2019] NZCA 347, BC201961314 — Nuku v R [2012] NZCA 584, [2013] 2 NZLR 39 — R v Taueki [2005] 3 NZLR 372 (CA). The defendant was up for sentencing for charges of aggravated robbery, aggravated driving while disqualified and theft of petrol, and a later charge of injuring with intent to injure. The defendant had robbed two people at knifepoint and had subsequently been arrested. While in custody, he attacked a corrections officer causing a fractured eye socket, cheekbone and nose. A starting point for the first set of charges was set at 2 years, with an additional 2 years and 8 months for the injuring with intent to injure. After taking into account a cultural report, the defendants age, and a guilty plea, the end sentence imposed was brought down to 3 years and 7 months imprisonment. Judgment Date: 19 May 2023.
