Sentencing — aggravated robbery — dishonestly using a document for pecuniary advantage — breach of bail — R v Mako [2000] 2 NZLR 170 — Sentencing Act 2002, s 27. The defendant appeared for sentence on a charge of aggravated robbery and 11 charges of dishonestly using a document for pecuniary advantage. She and two others devised a plan to extort money from the elderly victim. The defendant and one of the others then went to the victim's house, forcibly taking property worth approximately $6000 including his bank cards, later using them to withdraw over $8200 from his accounts. The stress of being attacked caused the victim to have a seizure and lose consciousness. Aggravating features were use of a weapon, major loss to the victim, abuse of trust, premeditation and previous convictions. In mitigation, the defendant was only 17 at the time of the offending, expressed remorse, offered to pay reparations, was willing to participate in restorative justice and pleaded guilty. The final sentence was three years two months' imprisonment. Judgment Date: 17 April 2019.
