Care of Children Act 2004, ss 105, 106 — Hague Convention on the Civil Aspects of International Child Abduction 1980 — Central Authority v Collins, 2012 NZFC 2694 Section 105 application was granted and order made for child abducted to New Zealand to be returned to the United Kingdom. Defence under s 106(1)(b)(ii) that the father “consented to, or later acquiesced in, the removal” was not proved on the balance of probabilities by the respondent (Collins).**Note: names have been changed to comply with legal requirements.
