The defendant appeared for sentence on charges of posting a digital communication with the intention of causing somebody harm; threatening to kill; breach of intensive supervision; and failing to comply with the direction of a medical officer of health under the COVID-19 emergency provisions. The harmful digital communications offending arose from the defendant seeking revenge for a failed relationship. The Court observed that this type of offending can cause ongoing harm to its victims. The start point for sentence was 12 months' imprisonment, uplifted an extra five months for the obstruction and breach of intensive supervision offences, as well as for prior convictions.
