Sentencing — immigration — providing false or misleading information — improper dealing with immigration or identity documents — Immigration Act 2009, ss 342(1)(b) & 345(1)(b). The defendant was to be sentenced after pleading guilty to charges under the Immigration Act. The defendant had been granted a Limited Purpose Visa and did not depart the country when that visa expired. Upon his eventual departure from the country, the defendant obtained a passport under a different name and date of birth which he used to obtain visas and return to New Zealand. The Court set the start point at two years' imprisonment. Discounts were given for the defendant's guilty plea, remorse and prior good record which reduced the sentence to 19 months' imprisonment. The Court then substituted this sentence for nine months' home detention. Judgment Date: 14 September 2023
