R v Abraham [2018] NZDC 3726

Sentencing — robbery of taxi drivers — robbery — theft — obtaining by deception. The defendant appeared for sentencing on multiple charges ranging from robbery to theft and obtaining by deception, for a series of crimes against taxi drivers. The defendant was charged with crimes against four separate taxi drivers; however, none of the offending involved physical injuries or weapons, and the sums stolen were relatively low. However, the Judge began with a starting point of three years' imprisonment. The Judge took a holistic view of the case in regards to aggravating and mitigating factors. The Judge uplifted the starting point for offending while on bail, the minor theft offences, and the re-sentencing in respect to previous sentences of community work and supervision. The mitigating factors were the counselling undertaken in prison, remorse, and rehabilitation. The final sentence was three years and one month's imprisonment and a three-strike warning.
