The District Court has a number of active proceedings relating to disputes about insurance claims from the 2010 and 2011 Canterbury earthquakes.
The recently enacted Canterbury Earthquakes Insurance Tribunal Act 2019 offers parties an alternative pathway to resolve an outstanding claim, and they may seek to transfer a matter from the District Court to the newly established tribunal.
The following Practice Note explains the process to legal practitioners for transferring proceedings to the Tribunal and takes immediate effect:
