Sentencing — causing harm by posting a digital communication — Harmful Digital Communications Act 2015, s 22 — Sentencing Act 2002, s 123B. The defendant appeared for sentence after pleading guilty to a charge of causing harm by posting a digital communication. He had sent naked pictures of the victim to members of her family. The aggravating features of the offending were abuse of trust and impact on the victim, and the Court set a start point of eight months' imprisonment. Mitigating features were the conduct of the victim (sending a photograph to the defendant's current partner) and guilty plea. The final sentence was nine months' supervision with conditions plus 40 hours' community work. The Court also made a protection order in favour of the victim. Judgment Date: 30 August 2019.
