Sentencing — sexual conduct with a young person — Crimes Act 1961, s 134 — Faapuea v R [2010] NZCA 20. Defendant sentenced to two years and three months’ imprisonment after having pleaded guilty to one charge of sexual conduct with a young person. A starting point of two years and nine months’ (derived from Faapuea) was uplifted by three months to take into account previous offending. A discount of 25 percent was made for the defendant’s guilty plea. Aggravating features of the offending included the victim’s vulnerability due to age and personal circumstances, and the age disparity that existed between her and the defendant. There were no mitigating features present.
