R v Mace Millar NZDC 10308
Published 20 September 2016
Historical sexual offending — rape — indecent assault — sentencing.
The defendant was sentenced to seven years’ imprisonment for sexual offending against five victims. Some of the offending occurred in the 1970s, with other offending in 2013 and 2014. The Judge took a cumulative sentencing approach to the two lead offences, one being recent and the other historic. It was therefore appropriate to consider the totality, which would have resulted in 12 years’ imprisonment. A discount was given for the defendant’s severe dementia.
