Application for declaration for change of sex on birth certificate — female to male — name change — transgender — Births, Deaths, Marriages and Relationships Registration Act 1995, s 29. The applicant sought an order pursuant to s 29 of the Births, Deaths, Marriages and Relationships Registration Act for a change of sex on the birth certificate of her child, from female to male. The applicant's child was 17 and had maintained the gender identity of a male for two years. The Court was satisfied that the child's parents intended to bring up the child as a male and wished for the child's nominated sex to appear on the birth certificate. The child had undergone medical treatment including hormone therapy, and a clinical psychologist confirmed the child's consistent presentation as a male throughout their sessions. The Court was satisfied that the child was more likely to be able to assume the gender identity of a male than of the opposite sex. The application and declaration sought was only available while the child was under the age of 18, which was important to the applicant as the child was due to turn 18 soon after the proceedings were heard.
