Sentencing — dangerous driving causing death — driving whilst suspended — failing to stop — speeding — drug driving — police chase — Sentencing Act 2002, ss 7 & 27. The defendant appeared for sentence on charges on of dangerous driving causing death, driving whilst suspended, and failing to stop. While suspended from driving, the defendant had driven an unwarranted car at high speeds while high on methamphetamine and cannabis. The defendant fled when the police tried to stop him. The chase ended when the defendant crashed, killing his passenger. The Court set the start point for sentence at five years eight months' imprisonment. The defendant was allowed a 20 per cent discount for guilty plea and for matters raised in a s 27 report, and another 15 per cent for remorse and accepting responsibility. With a further adjustment for the totality principle (the defendant was already serving a sentence for assault), the final sentence was three years four months' imprisonment. The defendant was also disqualified from driving for four years. Judgment Date: 20 November 2020
