Sentencing — illegal sale of fish — seafood — paua — sea cucumber — crayfish — illegal fishing — Fisheries Act 1996. The defendant appeared for sentence on a charge of selling fish otherwise than in accordance with the Fisheries Act. He had done so on 34 occasions, involving 4055 paua, 1840 sea cucumber and 57 crayfish. All the fish had been illegally caught and had a total value of some $25,000. A sentencing indication had shown a sentence of two years' imprisonment, which the Court uplifted by two months for previous offending. The defendant's guilty plea brought the sentence within the range for home detention. The Court substituted a sentence of seven and a half months' home detention, plus reparations of $324.45.
