New Zealand Police v Jaskaran Randhawa [2016] NZDC 5172 Assault — threatening to kill — Summary Offences Act 1981, s 9 — Crimes Act 1961, s 306. Charges proved beyond reasonable doubt. The common assault occured by way of force intentionally applied in an attempt by the defendant to pull the complainant towards him for a kiss - without consent from the complainant. The complainant’s evidence that a threat to kill had been made and taken seriously was accepted as the more reliable and consistent account of what had happened in the car. Judgment Date: 23 March 2016.
