Giving evidence in an alternative manner — hearsay evidence — Evidence Act 2006, ss 6, 16, 18 and 22.
An application to allow a witness to give evidence in an alternative manner was granted. Any potential prejudice to the defendant would be avoided as cross-examination of complainant would be shown to the jury by CCTV.
A separate application to have hearsay evidence admitted at trial was granted under s 22. The witness could not give evidence as she was now deceased.**Note: names have been changed to comply with legal requirements.
