Theft of a motor vehicle — Crimes Act, s 219(1)(b). Defendant charged under s 219 which states: “dishonestly and without claim of right, using or dealing with any property with intent to deprive any owner permanently of that property or of any interest in that property after obtaining possession of, or control over, the property in whatever manner.”
The Judge determined the essential elements of the charge were made out on the facts, and convicted the defendant of the charge.
