Sentencing — supply of methamphetamine — R v Fatu  2 NZLR 72 (CA) — R v De Serville HC Auckland CRI-2006-004-18441. Defendant fell within band 2 of tariff case Fatu. Band 2 prescribes a starting point for sentencing of three to nine years’ imprisonment.
Judge determined in light of De Serville that three years and nine months’ imprisonment was the correct starting point for the amount of methamphetamine involved.
After uplift for offending while on intensive supervision and previous history, a reduction of 25 percent for guilty plea, the defendant was sentenced to three years’ imprisonment.
