R v Brock Ayton NZDC 3672
Published 31 July 2016
Sexual offending against a child — sentencing. The defendant was sentenced to three years and three months’ imprisonment on three charges following a jury trial.
Aggravating factors were the victim’s age, the impact on victim and family, as well as the significant breach of trust involved.
No personal mitigating factors were present, and Crown submission accepted that the timeframe of the offending cancelled out any credit which might have been given for otherwise good character and lack of criminal history.
