Sentencing — rape — abduction — sexual offending — R v AM [2010] NZCA 114 — R v H CA436/02, 23 June 2003. The defendant appeared for sentence having been found guilty on charges of rape and abduction for sex. The victim and defendant were known to each other and, following a conversation, the defendant invited the victim back to a friend's place. The victim went with the defendant, but once it became clear the house was vacant the victim sought to leave. The defendant effectively picked up the victim and took her inside the address, where he sexually offended against her. The Judge, having considered case law, adopted a starting point of seven years' imprisonment. The Judge uplifted six months for prior offending but granted a three month discount for his apology and remorse. The end sentence was seven years three months. Judgment Date: 8 February 2019.
