Whether special circumstances existed to justify a final order — final adoption order — Adoption Act 1955, s 5. A final adoption order was made in favour of the applicants, the boys’ biological mother and her husband. Pursuant to s 5 of the Act a final order can be made at first instance if special circumstances exist. Special circumstances included the fact the boys’ consented to the order and had known the applicant as their father for a long time. **Note: names have been changed to comply with legal requirements.
