R v Ranginui [2019] NZDC 4064

Sentencing — rape — burglary — assault with intent to commit sexual violation — second strike. The defendant appeared for sentencing for one charge each of rape, burglary and assault with intent to commit sexual violation. The rape and the other two charges occurred at different times to different victims. The starting sentence was 10 years' imprisonment which was reduced to seven and a half years. At this hearing the Judge considered whether there were any other factors which would allow for a reduction of the final sentence. As it was the defendant's second strike he would have to serve the entire sentence with no eligibility for parole. The Judge described the defendant as being of above average intelligence, possessing skills and abilities. The probation report placed the defendant at an average risk of reoffending. It also described his childhood where he was moved from home to home and suffered the loss of loved ones. To give credit for the defendant's remorse, attempts at rehabilitation and potential to be a positive member of society a reduction of seven months was given, for a final sentence of six years and 11 months' imprisonment.
